Urgenda case. Conclusion about the duty of care Court orders the State to limit the volume of Dutch greenhouse gas emissions, or have them limited, so that this volume will have reduced by at least 25% at the end of 2020; "According to the scientific standard, a reduction target of [25% for 2020] is the absolute minimum and sufficiently effective, for the Netherlands, to avert the danger of hazardous climate change, but the obligation to adhere to a higher percentage clashes with the discretionary power vested in the State." Primaire stelling Urgenda c.s. is: - Staat is medeveroorzaker van (dreigende) klimaatverandering - Staat schendt art. 2 en 8 EVRM door onvoldoende mitigatiemaatregelen te nemen. Stellinen Urgenda: zie para. 170, 174 en 175 CvR Staat is niet degene die Nederlandse emissies verricht. Nederlandse emissies zijn qua omvang beperkt (0,5%) en Staat neemt wel degelijk mitigatie (en adaptatie)maatregelen. 4

Air quality UNEP Emission Gap Report 2014: het (nog steeds) mogelijk is de tweegradendoelstelling te realiseren en in dat kader in 2030 een zodanig mondiale emissiereductie te bewerkstellingen dat “it is feasible to close the 2030 gap and stay within the 2°C limit” (p. xxi) In Nederland komt, uitgaande van 2012, zo’n 40% van de broeikasgasemissies voor rekening van bedrijven die onder de ETS vallen. In 2020 is dat zo’n 45%. Daarna zal dit percentage nog iets stijgen, zo is de verwachting. Een aanzienlijk deel van de door Urgenda c.s. gewenste emissiereductie zou dan voor rekening moeten komen van de niet-ETS-sectoren, zoals vervoer (weg en spoor), gebouwen (met name de verwarming), diensten, kleine industriële installaties, landbouw en afval.
