The right to health is a right to an effective and integrated health system, encompassing health care and the underlying determinants of health, which is responsive to national and local priorities, and accessible to all. 13 ROG – Geschiedenis “Health is a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity. The enjoyment of the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition.” WHO Constitution, 1946

14 ROG- Geschiedenis The International Covenant on Economic, Social and Cultural Rights (ICESCR) (1966) was the first human rights treaty to require states to recognize and realize progressively the right to health, and it provides key provisions for the protection of the right to health in international law: 1. The States parties to the present Covenant recognize the right of everyone to the enjoyment of the highest attainable standard of physical and mental health. 2. The ICESCR enumerates some steps to be taken by states.

15 ROG - geschiedenis The Committee on Economic, Social and Cultural Rights (CESCR), which monitors States parties' implementation of the International Covenant on Economic, Social and Cultural Rights, has adopted General Comment 14 on the right to the highest attainable standard of health (2000): It identifies the core obligations that cannot be subjected to progressive realization. All states, regardless of their level of development, are required to take immediate action to implement them. Core obligations include: health care; socio-economic determinants of health; and health education. The requirement to provide assistance.

26 ROG – Internationale context Globalisering: Obstakels voor het recht op gezondheid op internationaal vlak. Multinationals, schuldenlast, brain drain, handelsakkoorden,... Niet enkel regeringen van ontwikkelingslanden hebben plichten; die van rijke landen des te meer. (verplichting om assistentie te verlenen!)
